Beta Terms of Use

Welcome to the HamRig Beta Program ("Service"). By accessing, downloading, or using HamRig software or cloud services, you agree to be bound by these terms. If you do not agree, do not use the Service.

1. Beta Status & "As Is" Disclaimer

You acknowledge that HamRig is in an active development phase (Beta). The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied.

We explicitly disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, error-free, or compatible with your specific hardware configuration.

2. Limitation of Liability

To the maximum extent permitted by applicable law, HamRig, its developers, and affiliates shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages, including but not limited to:

  • Hardware Damage: Damage to radio transceivers, amplifiers, antennas, tuners, or computer equipment (e.g., due to stuck PTT, overdrive, or frequency mismatches).
  • Data Loss: Loss of logs, settings, configurations, or personal data.
  • Service Interruptions: Loss of connectivity during critical operations (e.g., contests or emergency traffic).
  • Regulatory Fines: Fines, penalties, or license revocations resulting from improper transmission.

You are solely responsible for the physical safety of your equipment. We strongly recommend configuring hardware-level safety mechanisms (e.g., TOT timers, ALC limits) on your transceiver independent of software control.

3. Regulatory Compliance & Operator Responsibility

You are solely responsible for ensuring your use of HamRig complies with all local and international amateur radio regulations (e.g., FCC Part 97, CEPT T/R 61-01, BNetzA regulations).

  • You must ensure you are licensed to transmit on the frequencies and modes you select.
  • You must ensure your station identification (ID) requirements are met during remote operation.
  • You must verify that remote control is permitted in your jurisdiction and the jurisdiction where the station is physically located.
  • You agree not to use the Service for any unlawful purpose, including broadcasting music, interference, or encryption where prohibited.

4. Access & Termination

Access to the Beta is a privilege, not a right. We reserve the right to modify, suspend, or terminate your access to the Service at any time, for any reason, without notice or liability.

5. No Affiliation

HamRig is an independent software project. We are not affiliated with, endorsed by, or sponsored by Icom Inc., or any other hardware manufacturer mentioned. All product names, trademarks, and registered trademarks are property of their respective owners.

6. Indemnification

You agree to indemnify and hold harmless HamRig and its developers from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

By logging in or using the software, you acknowledge you have read, understood, and accepted these risks.
